Car Accident Attorney

Seriously injured in a car crash? Our car accident attorneys can help.

A serious car accident can cause serious injuries. An experienced car accident attorney can help.

Georgia law provides a remedy for individuals who are injured in catastrophic car accidents due to the negligence or unlawful behavior of another driver.

If you, a family member, or a loved one has been seriously injured in a car accident that was not your fault, there are several steps you need to take to protect your family and seek justice.

First, of course, is to seek the medical attention you need and to document the treatment you receive in order to calculate your total expenses later. It is also important to diagnose the full extent of your injuries and how they will affect you in the future.

The second thing you should do is file a police report or make sure the accident has been reported. This preserves evidence that you may need later.

Finally, one of the most important things you should do is contact one of our experienced car accident attorneys and determine whether to file a car accident lawsuit against the party at-fault and seek compensation for your injuries.

When should a car accident attorney file a lawsuit?

Under Georgia law, a person who is a victim of a serious car accident can file a lawsuit against the other driver who is responsible for causing the accident, who is generally referred to as the “at-fault” driver. The law also allows passengers to file lawsuits against the driver of the car they are traveling in if the driver is negligent and causes an accident.

In order to hold the at-fault driver accountable, a good car accident attorney will make a formal demand for compensation from the driver or their insurance company. Sometimes that means filing a personal injury lawsuit in court, sometimes it means negotiating with the insurance company. Either way, you will have to prove that the accident was the other driver’s fault and that the law entitles you to compensation.

In Georgia, a driver is responsible for a car accident if he acts negligently or violates the law while driving in a way that causes an accident. There are many ways in which a driver can act negligently or drive unlawfully, including:

  • Distracted driving, such as by texting while driving or not paying attention to their surroundings
  • Speeding and driving recklessly
  • Violating Georgia traffic laws
  • Driving under the influence
  • Driving without a license
  • Driving a car that is broken or faulty in a way that causes accidents, such as by driving with an old tire that blows out on the highway.
Our experienced car accident attorneys have seen it all, and we are confident we can help you prove that you have been the victim of a serious car accident, caused by another driver’s negligence, and that you are entitled to justice and fair compensation.

Why do I need a car accident attorney?

If you have been seriously injured in a car accident, it’s important to have an advocate by your side who knows the law in Georgia and can help you seek fair compensation for your injuries. Our car accident attorneys have over twenty years of experience doing just that.

We can help you:

  1. Evaluate the damages resulting from your accident and injuries, including the costs of medical treatment, lost wages, and the pain and suffering you’ve experienced. This allows us prove that your injuries were caused by the car accident, determine the maximum value of your case, and fight for the compensation you deserve.
  2. Investigate the scene of the accident and the criminal and driver history of the person who caused the car accident. It’s important to gather evidence early in the case, including traffic camera footage, witness statements, police reports, pictures of the scene, and other physical evidence. In some cases, we can hire an expert to “recreate the accident” by examining the scene of the accident and other evidence to explain how the at-fault driver’s negligence or poor driving caused the accident and your injuries.
  3. Obtain the at-fault driver’s insurance information and other information that will help us prepare a claim to seek compensation for the injuries you suffered from the car accident. If the driver who caused your accident was driving for a company, you may have a claim for compensation against the employer as well.
  4. Prepare a “demand letter” to send to the at-fault driver’s insurance company that sets out the facts of the accident, establishes that their client was at-fault, and makes a monetary demand based on the injuries you have suffered as a result of the accident. In some cases, a strong demand letter can get you the compensation you deserve without having to file a lawsuit or go to court.
  5. File a personal injury lawsuit in court when the insurance company won’t make you a fair offer of compensation. It is especially important to have an experienced car accident attorney to help you do this, as there are many procedural rules and laws in Georgia that you must comply with or your case may be dismissed.
  6. Negotiate a fair settlement or take the insurance company to trial to make sure you are paid the compensation you deserve.

Why should I hire a car accident attorney at Pate, Johnson & Church?

Our car accident attorneys have been helping people seek justice for over twenty years. Judges, opposing counsel, and insurance companies know we have a reputation for fighting hard for our clients and, more importantly, winning in the courtroom.

We are also different from car accident lawyers that will encourage you to take the insurance company’s first or second settlement offer in order to make a quick buck. When we accept your case, we will maximize your leverage by preparing as if we are taking the insurance company to trial. We believe that’s the best way to get a fair offer from the insurance company and to get you the full value of your case if the insurance company won’t settle on your terms.

We also only take a limited number of cases so we can put as much time and effort as possible into your case. And when you call our firm to get an update on your case or ask a question, you’ll be talking to one of our car accident attorneys, not a case manager.

Contact our experienced car accident attorneys if you have been seriously injured in a car accident and want to know your rights.
